No update date specified in the Service or any related website shall be construed as a warranty that all information in the Service or any related website is correct and up-to-date.
 
7. PROHIBITED USES
 
In addition to the other prohibitions set forth in the Terms and Conditions of Service, you may not use the Site or its contents

8. WARRANTY DISCLAIMER; LIMITATION OF LIABILITY
 
I do not warrant, represent or claim that the use of my service will be uninterrupted, timely, secure or error-free.
 
Under no circumstances shall Maria Isola be liable for any injury, loss, claim or direct, indirect, incidental, punitive, special or consequential damages of any kind - including but not limited to lost profits, lost savings, lost data, replacement costs or other similar damages, whether in contract, tort (including negligence), strict liability, or otherwise - arising out of the use of any of the services or products obtained using the service, or for any other claim relating in any way to the use of the service or product, including, but not limited to, any errors or omissions in any content, loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available through the service, even if advised of the possibility thereof.
Because some countries or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, my liability in such countries or jurisdictions shall be limited to the maximum extent permitted by law.
 
9. CONFIDENTIALITY
 
All documents sent to Maria Isola will remain strictly confidential.
 
10. TRANSLATION REQUESTS NOT ACCEPTED
 
Maria Isola will not translate any document that does not comply with the law or that could be considered pornographic or racist in any way.
 
11. COPYRIGHT
 
The copyright of all completed translations will automatically become the property of Maria Isola unless otherwise stated in the quotation provided.
 
12. FORMAT OF SOURCE DOCUMENTS
 
Maria Isola only accepts text files supported by MS Office.
 
13. CHECKING DOCUMENTS BEFORE SUBMISSION

The client is responsible for the content of all documents sent to Maria Isola.
 
The client must ensure that only correct, relevant and unduplicated documents are sent to Maria Isola.
 
14. MINIMUM CHARGE

I apply a minimum charge of €15 for all translation requests of less than 250 words.
 
15. DISCOUNTS AND PREFERENTIAL RATES

For orders of 3,000 words or more, discounts and preferential rates may be applied, if requested, at the translator's discretion, and if portions of text are repeated throughout the document or the document contains duplicated paragraphs or pages.
 
16. START OF TRANSLATION
 
Translation will only start once payment has been received.
I normally work from Monday to Friday from 9.30 a.m. to 5 p.m. (Rome local time). For any urgent work, I may decide to work at weekends and on public holidays by prior agreement, which will entail the application of a surcharge to be agreed in advance at the time of the quotation.
To guarantee a swift order fulfilment, orders must be placed between 8.00 and 20.00 (Rome local time), Monday to Thursday, and before 15.00 (Rome local time) on Fridays. Any orders whose payment is received after those hours will not be processed until the next working day.
 
17. CALCULATION OF DELIVERY DATE

Normally, I translate up to 2,500 words per day. The 24-hour turnaround time refers to translations of up to 1,000 words. Unless otherwise agreed in advance, translation delivery dates are calculated from the moment Maria Isola receives proof of payment within the aforementioned working hours.
 
18. REQUEST FOR CHANGE OF DELIVERY DATE

Once the order has been placed, the agreed delivery date cannot be changed and the order cannot be cancelled.
 
19. PAYMENT
 
Payment must be made by the agreed method specified at the time of ordering. I accept payments by SEPA bank transfer (preferred) or by Paypal.
 
Unless otherwise agreed, all orders below €1,000 must be paid immediately for the full amount specified on the invoice before the translation process starts.
 
Unless otherwise agreed, all translation orders exceeding €1,000 require a deposit of 50% of the full invoice amount before the start of the translation process. The balance is due one week after completion of the translation process. In the event of non-payment of the deposit, Maria Isola will be relieved of any responsibility for the translation request.
 
For all urgent translation orders, the full amount must be paid in advance, regardless of the price.
 
20. PROOF OF PAYMENT
 
The client must provide proof of payment by SEPA bank transfer (preferred) or PayPal. The translation work will start immediately upon receipt of the proof of payment. Failure to provide proof of payment will delay the start of the translation process.
 
21. LIMITED LIABILITY
 
Any specific terminology preferences must be specified before the translation process starts.
 
Maria Isola's liability is limited to the amount specified on the invoice. The client waives, in any case, any claims for damages arising from any losses incurred.
 
22. COMPLAINTS
 
No complaint relating to the quality of the translation delivered will be accepted unless submitted in writing by e-mail within seven calendar days of delivery. Full payment of the invoice or the remaining balance may not be withheld by the client under any circumstances.
 
In all cases, Maria Isola is committed to amicable negotiations and believes that her client services should be provided in a spirit of cooperation. Accordingly, in the event of a complaint relating to quality, the client must provide clear evidence of any such complaint. Maria Isola will then check and correct the original translation at no cost. Complaints regarding stylistic nuances or lexical connotation will not be considered. All complaints will be considered unfounded if the writing quality of the source text prevents the translator from understanding it correctly. Complaints will be considered unfounded if the source text is unintelligible.
 
23. DELIVERY BY E-MAIL
 
All orders will be delivered by e-mail to the e-mail address provided by the client. Maria Isola shall not be liable for delays or non-deliveries if the client provides a non-existent, incorrect or incomplete e-mail address.
Maria Isola undertakes to start the translation process as soon as she receives proof of payment from the client at the hours specified in the quotation and excluding weekends and public holidays (unless otherwise agreed). Even if the translation itself is completed within the deadline agreed upon in the quotation, any additional time required by any third parties involved is not Maria Isola's responsibility.
 
24. ORDER CANCELLATION
 
The client will be 100% liable for any order cancelled after acceptance of the quotation drawn up by Maria Isola or after payment has been made. The client will be liable for 100% of the amount due.
 
The balance must be paid in full within 3 working days of Maria Isola sending the electronic invoice.
 
25. PROFESSIONAL LIABILITY AND FORCE MAJEURE
 
Maria Isola will do her best to ensure the swift completion of each translation project.
 
Maria Isola's liability is limited to the amount of the invoice. Maria Isola may never, under any circumstances, be the subject of a client's claim for damages or for any harm suffered.
 
Maria Isola shall in no way be held responsible for delays and/or events of force majeure due to interruption of the internet service and/or electricity supply, adverse weather conditions, disasters, accidents, illness, etc.).
 
26. GENERAL TERMS OF ACCEPTANCE OF THE PURCHASE ORDER:
 
Payment of the order shall be construed as acceptance by the client of the quotation and of the General Terms of Sale of Maria Isola's translation services.
 
27. COMPENSATION
 
You agree to compensate, defend and hold Maria Isola harmless against any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms and Conditions of Service or the documents referenced herein, or your violation of any law or the rights of a third party.
 
28. SEVERABILITY
 
Should any provision of these Terms and Conditions of Service be held unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms and Conditions of Service, without affecting the validity and enforceability of the remaining provisions.
 
29. TERMINATION
 
The obligations and responsibilities assumed by the parties prior to the date of termination shall survive to all intents and purposes upon termination of this Agreement.
 
These Terms and Conditions of Service shall be effective until terminated by either you or me. You may terminate these Terms and Conditions of Service at any time by notifying me that you no longer wish to use my Services.
In addition, if in my sole judgment you violate or are suspected of violating any provision of these Terms and Conditions of Service, I may terminate this Agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; accordingly, I may deny you access to the Services (or any part thereof).
 
30. ENTIRE AGREEMENT
 
Failure to exercise or enforce any right or provision of these Terms and Conditions of Service shall not constitute a waiver of such right or provision.
 
These Terms and Conditions of Service and any policies or operating rules posted by me on this site or in connection with the Service constitute the entire agreement and understanding between you and me and govern your use of the Service, superseding any prior or current agreements, communications, and proposals, whether oral or written, between you and me (including, but not limited to, any prior versions of the Terms and Conditions of Service).
Any ambiguity in the interpretation of these Terms and Conditions of Service shall not be construed against the drafting party.
 
31. APPLICABLE LAW
 
These Terms and Conditions of Service and any separate agreements under which I provide the Services to you shall be governed by and construed according to the laws of Cagliari, Italy.
